Beginning early next year, any platform operating within the 27-nation bloc—including major social media networks, search engines, and content-sharing sites—must embed visible markers and metadata tags on output created by generative AI tools like chatbots and image synthesizers. Failure to comply could result in fines of up to 7% of a company’s global annual revenue, a penalty structure designed to mirror the EU’s stringent data privacy regime under the General Data Protection Regulation (GDPR).
How the System Will Work
The regulation does not dictate a single technological solution. Instead, it establishes performance standards for labeling. Companies can choose from several methods, provided the label is “clear, prominent, and unmistakable” to the average user.
- Visual Watermarks: Subtle, machine-readable icons or text overlays that appear on images and videos.
- Metadata Tags: Cryptographic markers embedded in a file’s code—invisible to the eye but detectable by software—that can trace an asset’s origin.

European lawmakers have cited a surge in AI-generated political propaganda and financial scams as the primary motivation. During the recent Slovakian election, for example, audio deepfakes of a party leader discussing vote-rigging spread rapidly on Facebook before being debunked—by which point the material had been viewed hundreds of thousands of times.
“We cannot allow the public square to become a place where citizens cannot trust what they see or hear,” said Margarethe Vestager, the EU’s digital chief, in a statement announcing the final text of the law. “Transparency is the first line of defense against manipulation.”
Industry Reaction and Security Concerns
The response from the tech sector has been mixed. OpenAI, the creator of ChatGPT, has voluntarily rolled out watermarks for its own image generator, DALL-E 3. However, the company has previously acknowledged that digital watermarks can be stripped by determined users.
Some cybersecurity experts warn the labeling itself could become a vulnerability. “If every legitimate government announcement and official video carries a distinct AI tag, a bad actor could replicate that tag and embed it into a fake,” cautioned Dr. Elena Korosteleva, a digital policy fellow at the University of Cambridge. “We are essentially building a new layer of the internet that must be hardened against attack.”

The EU’s move sets a potential global precedent.
